Heard learned counsel for the respective parties.

Instant petition under Section 482 BNSS is filed for pre-arrest bail of the petitioner in connection with Chamakhandi P.S. Case No. 48 of 2023 corresponding to G.R. Case No. 216 of 2023 pending in the file of the learned S.D.J.M., Chatrapur on the grounds stated therein.

Perused the FIR as at Annexure-1. This Court finds that the petitioner had earlier approached this Court twice in ABLAPL Nos. 13606 of 2024 and 2621 of 2025. A copy of the order in ABLAPL dated 6^th December, 2024 is produced by Mr. Sahoo, learned counsel for the petitioners. The order of the other ABLAPL is at Flag-B2. In the first bail order, the petitioner was allowed to go on bail subject to verification of antecedent against him and it could not be availed of since he has two criminal cases against him. In the second bail order dated 10^th April, 2025 in ABLAPL No. 2621 of 2025, it was

directed for the petitioner to surrender for being released subject to absence of any Sessions triable case registered against him. Mr. Sahoo, learned counsel informed to the Court that the petitioner has a case registered under Section 307 IPC, hence, once against he failed to comply the order in the ABLAPL disposed of on 10^th April, 2025. Recorded the objection of the State. Mr. Panda, learned ASC submits that the petitioner could have approached this Court seeking modification of the orders in the ABLAPLs. Response to the same of Mr. Sahoo, learned counsel for the petitioner is recorded. Considering the fact that on earlier occasions, the petitioner was allowed to go on bail upon surrender before the court below, this Court is inclined to direct him again to surrender with suitable conditions imposed and only if he has not more than three criminal cases including one Sessions triable offence.

4. Accordingly, it is ordered.

In the result, the ABLAPL petition stands disposed of with a direction to the petitioner to surrender before learned S.D.J.M., Chatrapur within a fortnight from today and in the event, he surrenders in compliance thereof, shall be released on bail in connection with G.R. Case No. 216 of 2023 on furnishing a bail bond of Rs.50,000/- (rupees fifty thousand) with one solvent surety for the like amount to the satisfaction of the court below, which shall be at liberty to impose such other suitable conditions as deemed just and proper in the facts and circumstances of the case. It is directed that the above order shall be given effect to if only it is found that the petitioner has
