02. 1. Heard learned counsel for the Petitioner and learned counsel for the State.

The Petitioner is seeking pre-arrest bail in connection with Spl. G.R. Case No. 14 of 2026 pending on the file of learned ADJ-Cum-Special Court under POCSO Act, Puri, arising out of Talabania P.S. Case No.233 of 2025 for commission of offences punishable under Sections 140(2)/137(2)/296/351(2)/3(5) of BNS and read with Sections 3(1)(r)/3(1)(s)/2(va) of SC/ST (PoA) Act, 1989.

On instruction, learned counsel for the State intimated this Court that notice of this application has been duly served on the Informant.

There is no appearance from the side of the Informant when the matter is called.

Counsel for the Petitioner submits that admittedly the Petitioner is not the principal accused and the allegations against him is of facilitating the principal accused to commit the offence. Hence, the Petitioner may be protected by pre-arrest bail.

Learned counsel for the State opposes the prayer of pre-arrest bail.

Considering the submissions made, the tenor of statement of victim recorded under section 183 of BNSS and taking into account the submission of final form, it is directed that on surrendering within three weeks hence and moving for bail, Petitioner shall be released on bail by the learned Court in seisin on such terms as deemed just and proper.

The ABLAPL is accordingly disposed of. Issue urgent certified copy as per rules.
