Pramod Kumar Panda Vs State of Odisha

The Petitioners are seeking pre-arrest bail in connection with Dhanupalli P.S. Case No.149 of 2026 pending on the file of learned Court in seisin for commission of offences punishable under Sections 115(2)/ 296/ 3(5)/ 351(2)/ 85 of BNS, 2023 and Section 4 of D.P. Act.

It is submitted by the learned counsel for the Petitioners that there are series of litigation inter se between the Petitioner No.3 and Informant, who is his wife in as much as it is stated that the Petitioner No.3 has filed CP No.661 of 2023 in the Court of the learned Judge, Family Court, Cuttack for dissolution of marriage and there is D.V. Case No.188 of 2024 on the file of the learned S.D.J.M., Jajpur and petition for restitution of conjugal rights at the instance of the Informant CP No.55 of 2026 in the Court of the learned Judge, Family Court, are pending.

Considering the same, it is submitted by the learned counsel that the allegations as leveled have to be considered in the light of the said litigation. Hence, the Petitioners may be protected by pre-arrest bail.

Learned counsel for the State opposes the prayer for pre-arrest bail.

Considering the nature of allegations and the background in which the same has been leveled and in view of the litigation noted hereinabove, it is directed that on surrendering within three weeks

hence and moving for bail, the Petitioner No.3 (Pritam Kumar Panda) shall be released on bail by the learned Court in seisin on such terms as deemed just and proper.

So far as Petitioner Nos.1 & 2 are concerned, taking into account that they are the in-laws, this Court directs that in the event of arrest of the Petitioner Nos.1 & 2 (Pramod Kumar Panda & Manasi Panda respectively) in connection with the aforesaid case, they shall be released on bail by the Arresting Officer on such terms and conditions deemed just and proper with further conditions that they will cooperate with the investigation.
