Surendra Kumar Sahu Vs State of Odisha (Vigilance)

ABLAPL No.287 of 2026 and ABLAPL No.13541 of 2024 under Section 482 BNSS are filed seeking pre-arrest bail of the petitioners in connection with Koraput Vigilance P.S. Case No.36 of 2025 corresponding to GR(V) No. 14 of 2025 and ABLAPL No.13510 of 2024 and ABLAPL No.13602 of 2024 by the petitioners in connection with Koraput Vigilance P.S. Case No.35 of 2025 corresponding to GR(V) No.13 of 2025 pending in the file of learned Special Judge (Vigilance), Bhawanipatna arising out of on the grounds stated.

Perused the FIR in ABLAPL No.287 of 2026 as at Annexure-1 and the allegations contained therein. Recorded the submissions of learned counsels for the parties. In course of hearing, learned counsel for the Vigilance Department, upon receiving instructions from the Inspector of the Vigilance, Bhawanipatna, submits that the petitioner in ABLAPL No.287 of 2026 is extending cooperation in the investigation which is currently underway. As regards, the other ABLAPLs, the submission is that FIRs have been lodged in the meantime and the investigation is in progress. Recorded the reply of learned counsels for the petitioners.

The allegation as made to appear from Annexure-1 in ABLAPL No.287 of 2026, the petitioners allegedly misappropriated an amount of Rs.5,90,970/- and it was in relation to a project work undertaken by them under the MGNREGA scheme. It has been alleged in the FIR that the road and ponds have not been constructed in execution of the project work. Considering the nature of allegations revealed from the FIR as at Annexure-1 in ABLAPL No.287 of 2026 and in the meantime, sine reports have been lodged after enquiry and the petitioners happen to be the vendor, Sarpanch. P.E.O., J.E. and G.R.S. should be directed to surrender before the learned court below for being released on bail with conditions that all shall extend cooperation to the I.O without default.

In the result, the ABLAPLs are disposed of with the direction as aforesaid. In the event, the petitioners surrender before the court of learned Special Judge (Vigilance), Bhawanipatna within a fortnight from today, it is directed that they shall be released on bail in connection with Koraput Vigilance P.S. Case No.36 of 2025 corresponding to GR(V) No.14 of 2025 and Koraput Vigilance P.S. Case No.35 of 2025 corresponding to GR(V) No.13 of 2025 respectively on furnishing bail bonds of Rs.50,000/-(rupees fifty thousand) each with one solvent surety for the like amount each with such other conditions imposed as deemed just and proper in the facts and circumstances of the case and at the same time, all shall

cooperate the I.O. in the investigation and make themselves available as and when summoned.
