01. 1. Heard learned counsel for the Petitioners and learned counsel for the State.

The Petitioners are seeking pre-arrest bail in connection with G.R. Case No.457 of 2026 pending on the file of learned SDJM, Kendrapara arising out of Derabish P.S. Case No.202 of 2026 for commission of offences punishable under Sections 85, 296, 115(2), 351(2), 351(3) and 3(5) of BNS read with Section 4 of DP Act.

It is submitted by the learned counsel for the State, on instruction, that the prosecuting agency

has taken recourse to the provisions as contained in Section 35(3) of BNSS in respect of Petitioner Nos.1, 2 & 6, who are the father-in-law, mother-inlaw and husband respectively.

Considering the same, the ABLAPL is confined to Petitioner Nos.3 to 5 & 7.

Accordingly, the ABLAPL in respect of Petitioner Nos.1, 2 & 6 (Umakanta Sahoo, Jamuna Sahoo and Chakradhar Sahoo respectively) stands disposed of.

Taking into account the nature of allegation and that 35(3) of BNSS has been resorted to in respect of the other co-accused including the husband, this Court directs that on surrendering within three weeks hence and moving for bail, the Petitioner Nos.3 to 5 & 7 (Manini Sahoo, Jayanti Sahoo, Harishankar Sahoo and Jagannath Sahoo respectively) shall be released on bail by the learned Court in seisin on such terms as deemed just and proper.

It is needless to state that the Petitioner Nos.3 to 5 & 7 shall cooperate with the ongoing investigation.

Accordingly, the ABLAPL stands disposed of.
