Petition prayer reads as under:

“It is therefore, prayed that this Hon’ble Court be graciously pleased to admit the writ application, issue rule NISI in the nature of writ of mandamus or any other writ/writs as deem fit and proper calling upon the opposite parties to show-cause as to why the Education Volunteers and Sikshya Karimis appointed by the petitioner organization in the primary schools under Morada Education Circle and 375 Sikshya Karmi appointed in equal numbers of non-formal education centres opened by the petitioner organization shall not be appointed as Sikshya Sahayak within a stipulated period.

In the event of the opposite parties fail to showcause or show insufficient cause said rule be made absolute.”

Learned counsel for the petitioner very fairly submits that petition be disposed off by reserving liberty to his client to make an appropriate representation to OP No.3 by providing all necessary data and evidentiary material. He also prays that if such

a representation is made, OP No.3 shall take a decision on that, within a reasonable time and in accordance with law. With this proposal, learned AGA is agreeable.

In the above circumstances, Writ Petition is disposed off. If such an application is made, the same shall be heard and decided after giving an opportunity of hearing to all the stakeholders within an outer limit of three (3) months. All contentions are kept open.
