This writ petition has been filed by the petitioner Budhuram Rathiya with a prayer for a direction to the land acquisition officer, Sundergarh (O.P. No.3) to take a decision on the application filed by the petitioner under Annexure-1 regarding reference of the dispute with

regard to apportionment of compensation for the acquired land under Khata No. 16, Mouza- Jamkani under Hemgiriu Tahsil within a stipulated period.

The prayer is made in the application (Annexure-1) to make the reference under Section 30 of the Land Acquisition Act. But perusal of Annexure-1 reveals that nobody has signed in the application even though in the first page of the application the name of the five applicants is mentioned. One LTI has been given in page 2 but it is not mentioned whose LTI it is.

In view of the above state of affairs, the learned counsel for the petitioner seeks permission to withdraw this writ petition in order to file a proper application before the concerned authority.

Accordingly, the writ petition is disposed of.
