Heard learned counsel for the petitioner as well as learned Additional Standing Counsel for the State-Opposite Parties. Perused the writ petition as well as documents annexed thereto.

The present writ petition has been filed by the petitioner with the following prayers:

“It is therefore humbly prayed that this Hon'ble Court

may graciously be pleased to admit the case, call for the records and after hearing both the parties pass the following reliefs;

i) To quash the order dtd.10.2.2023 under Annexure-7 ii) To direct the Opp.Parties to appoint the petitioner as Fireman treating his height as 179 cm.

iii) To direct the Opposite Parties to remeasure the height of petitioner in presence of the recruitment board.

iv) To direct the Opp.Parties to appoint the petitioner from the date when others have got in response to same selection process.

And pass such other order/orders as may be deemed fit and proper for the interest of justice.”

In course of hearing, learned counsel for the Petitioner submits that the Petitioner may be granted liberty to file a fresh representation ventilating his grievance before the Director General of Fire Services, Odisha, Cuttack, Opposite Party No.2 which may be considered within a stipulated period of time in accordance with law.

Learned Additional Standing Counsel on the other hand submits that he has no objection if liberty is granted to the Petitioner to file a fresh representation before the Opposite Party No.2 and the same is considered and disposed of in accordance with law.

In view of the aforesaid limited nature of grievance of the petitioner, this Court disposes of the writ petition granting liberty to the Petitioner to file a fresh representation before the Opposite Party No.2 ventilating his grievance within a period of two weeks. If such a representation is filed within the time stipulated, the same shall be considered in terms of order passed by a Coordinate Bench of this Court in the case of Chandan Jhankar v. DG and IG of Police, Odisha, Cuttack and others (WPC(OAC) No.1415 of 2019 vide order dated 10.03.2022) and disposed of by the Opposite Party No.2 within a period of four weeks from the date of filing representation by passing a speaking and reasoned order. In the event the Opposite Party No.2 comes to a conclusion that the case of the Petitioner is covered by the ratio laid down in Chandan Jhankar ’s case, then necessary follow steps be taken by directing the Opposite Party No.5 to constitute a medical board and re-assess the height of the Petitioner.
