“Under these facts and circumstances the petitioners most humbly pray that this Hon'ble Court be graciously pleased to admit this Writ Petition and issue a RUT,F NISI calling upon the 0pp. Parties to show cause as to why:

(i) The letter dated 06.01.2024 issued by the Opposite Party No-2 under Anncxure- 7 and shall not be set aside/ quashed.

(ii) The action of the Opposite Party No-2 in empanelling the Petitioner Hospital from the BSKY Scheme shall not be declared as illegal, arbitrary and contrary to law,

As per the Fire Prevention and Safety Inspection Report dated 17.02.2025 submitted by the learned counsel for the the requirement of open space means of access, entrance, exit and stairecase of the occupancy shall be as per respective regulation or Bye-laws which is not available in the present case. The observation made by the Deputy Fire Officer, Bhubaneswar Circle, Bhubaneswar in Fire Prevention and Safety Inspection Report dated 17.02.2025 is extracted hereunder:

Observation : Inspected the Fire and life safety arrangement in G+4 Storied Hospital building (Sai saburi Hospital) situated Over plot no.882 (part), Khata No.459/2, Mouza-Purana Pradha, Balianta, DistKhurda along with Station Officer Balianta Fire Station on dtd.17.02.2025 in present of Mrs. Smuti Sarika, Director of the hospital. The inspection report is prepared as per requirement of OFP & FS (Amendment) Rules-2019 & NBCI-2016.

1. The Building Plan to be approached by competent Plan Approving authority.

2. Setback to be required all-around the building as per ODA Rules2020.

3. Staircase to be required Natural/mechanical ventilation.

4. Exit signage to be provided adequately.

Hence, the applicant need to comply the shortfalls on is point as mention in column no.6 and Sl no.50.”

In view of the Fire Prevention and Safety Inspection Report dated 17.02.2025, the Petitioner is directed to comply with the deficiency as pointed out by the Deputy Fire Officer, Bhubaneswar Circle, Bhubaneswar in the said report. It is made clear that if the deficiency is removed, the Petitioner’s case may be considered by the Health and Family Welfare Department for enrolment under the GJAY Scheme. After removal of the deficiency, the Petitioner shall approach the Health and Family Welfare Department and the said Department shall take proactive step to enroll the Petitioner’s hospital under the GJAY Scheme.

Accordingly, the Writ Petition is disposed of.
