Service matter — WP(C) No.31810 of 2025, High Court of Orissa, Dixit Krishna Shripad, J., order dated 11.12.2025. Petitioner sought quashing of the order at Annexure-2 and payment of differential pay on the scale of Rs. 15,600-39,100/- with Academic Grade Pay of Rs. 6,000/- from 23.07.2016 to 04.11.2019, relying on the Co-ordinate Bench decision in Srabanee Mishra v. State of Odisha, WPC(OAC) No.1011 of 2017 (disposed of 19.12.2023), and on her representation dated 06.09.2025. On the joint proposal of counsel, to which the learned AGA agreed subject to contentions being kept open and a reasonable time being fixed, the Court disposed of the writ petition without deciding the merits, directing that a decision on the representation be taken and communicated within six weeks, permitting the opposite parties to seek information or documents from the petitioner provided no delay is caused, and making no order as to costs.

Petition prayer reads as under:

“Under the above circumstances, It is therefore humbly prayed that, this Hon'ble Court may graciously be pleased to consider the facts stated in the petition, admit the same and issue Rule NISI by calling upon the Opp. Parties to Show-Cause as to why the Order under Annexure-2 shall not be set-aside and if the Opp. Parties fail to Show-Cause or show insufficient cause the said Rule be made sufficient and the Order under Annexure-2 may be quashed with a further direction to the Opp. parties to pay the differential amount after allowing the scale of pay of Rs. 15,600- 39,100/- with Academic Grade pay of Rs. 6,000/- with subsequent increments and revision from 23.07.2016 to 04.11.2019.

And / Or may pass any such other order (s)/ direction(s) as this Hon'ble Court thinks fit and proper for the ends of justice;”

In support of the prayer, learned counsel appearing for the petitioner draws attention of the Court to Co-ordinate Bench decision in WPC(OAC) No.1011 of 2017 between Srabanee Mishra v. State of Odisha, disposed of on 19.12.2023. He also draws attention of the Court

to his client’s representation dated 06.09.2025, the copies whereof are at Annexure-5 series in that connection.

Counsel for the petitioner submits that if the subject representation is considered in the light of Co-ordinate Bench decision, his client will be satisfied. With this proposal, learned AGA is also agreeable subject to condition that all contentions should be kept open and a reasonable period be prescribed for disposal of the representation.

In the above circumstances, writ petition is disposed off. Time for compliance is six weeks which would include communicating the decision taken on the subject representation to the Petitioner. All contentions are kept open.

It is open to the answering opposite parties to solicit any information or documents from the side of the Petitioner, as required for taking a decision on the subject representation. However, in that guise delay shall not be brooked.

Now, no costs.
