In this Writ Petition, the Petitioner has sought for a direction from this Court to the Opposite Parties/Bank to defreez the Bank Account bearing No. 3076011004100 at UCO Bank, Azimabad Branch, Balasore.

Learned counsel for the Petitioner submits that the Petitioner had deposited a cheque bearing No.04 of Rs.10,00,000/issued by one Trailakya Nath Mishra to be enchased in his account at UCO Bank, Azimabad Branch, Balasore. She further submits that the said Trailakya Nath Mishra had also lodged a complaint with the National Cyber Crime Reporting Portal bearing a Cyber Fraud Acknowledgement No.3076011004100. UCO Bank, Azimabad Branch, Balasore through e-mail that the account of the Petitioner has been reported as beneficiary of fraudulent transaction. Therefore, the account of the Petitioner has been freezed by the Opposite Parties/Bank.

Learned counsel for the Petitioner further contends that the Petitioner is not involved in any fraudulent transaction. Hence, freezing of the above noted account of the Petitioner is illegal.

Learned counsel for the Opposite Parties/Bank submits that the disputed amount may be kept as a lien and the Petitioner may be allowed to operate his bank account.

Considering the submission made on behalf of the parties and looking to the factual scenario of the case, this Court directs the Opposite Party No.4/The General Manager, UCO Bank, Azimabad Branch, Balasore to maintain a sum of Rs.10,00,000/- (Rupees ten lakhs only) in respect of the bank account of the Petitioner bearing No.3076011004100 as lien till conclusion of the case and permit the Petitioner to make necessary banking transaction for the rest of the amount from the said accounts forthwith.
