1. Petitioners claiming to be the villagers, came up before this Court by way of filing this Public Interest Litigation flagging an issue that Gram Panchayat Office is getting constructed on gochar land bearing Plot No.458 in Khata No.371 under Anandapur Mouza, though other Government land is available in Mohammadpur Mouza.

It is submitted by learned Advocate that the villagers of Aajipur, Mohamadpur and Anandapur depend on such gochar land for the purpose of grazing of cattles and also use said plot as approach to bus stop, community health centre, post office and bank, etc . As gochar land is not meant for any construction to be made over it, it is submitted by learned Advocate for the petitioners that the opposite party No.4, namely, Block Development Officer, Simulia in the district of Balasore is required to be restrained from proceeding with such construction of Gram Panchayat Office at Anandapur over said land.

2.1. Mr. Debashis Tripathy, learned Addl. Government Advocate appearing for the opposite parties upon furnishing a copy of the written instruction received from the Tahasildar, Simulia submitted that the aforesaid plot bearing No.458 under Khata No.371 under Anandapur Mouza having Ac.8.50 decimals gochar land under Rakhita Khata out of which Ac.1.00 decimals is carved out and allotted in favour of the Panchayati Raj and Drinking Water Department for construction of Gram Panchayat building by an Order bearing No.185/200211487/PR, dated 18.11.2002 in terms of Section 3A of the Orissa Government Land Settlement Act, 1962. He further submitted that said patch of land, being carved out from total area of Ac.8.50 decimals has already been dereserved/converted from Kisam: Gochar to Kisam: Patita vide Letter No.4666/Rev, dated 23.05.2025 and the construction of the Gram Panchayat building is in progress over the said land.

In view of said categorical statement made by the Tahasildar, Simulia, as is apparent from the instructions imparted to the learned Additional Government Advocate, keeping the matter pending would subserve no purpose as this Court does not find any merit in the contentions raised by the petitioners.

4. In the result, the writ petition sans merit, stands dismissed.
