Heard learned counsel for the parties.

The present Writ Petition has been filed by the Petitioners with the following prayer:

“Therefore, it is most humbly prayed before this Hon'ble court that, this Hon'ble court may graciously be pleased to:

(i) admit the Writ Petition;

¶18

(ii) issue notice to the Opposite Parties and call for a ground level report from the Tahasildar-Opp. Party No.3 in respect of Annexure1 and being satisfied, may issue appropriate writ / writs against the Opp. Party No.l to 5 and direct the Executive Officer-Opp. Party No.5 to take necessary legal steps as against the Opp. Party No.6 and provide smooth ingress and egress to the petitioners and other local inhabitants to their respective residential plots through the public road, passing through Plot No. 774/2305, under Khata - 465, Mouza - Titilagarh, district - Balangir with immediate effect; (iii) And /Or, any other Order / Orders or Direction / Directions ma y be passed as would be deemed fit and proper by this Hon'ble court;”

Learned counsel for the Petitioners submits that the Opposite Party No.6 has obstructed the public road by constructing a house which is caused much hardship to the Petitioners and other local inhabitants to access to their residential plots. He further submits that the Petitioners have approached the Opposite Party Nos.2 to 5 for redressal of their grievance. But, till date no action has been taken against the Opposite Party No.6. Hence, the Petitioners are constrained to approach this Court.

In view of such facts and submission, without going into the merit of the case, the Petitioners are directed to approach the Opposite Party No.4/ Tahasildar, Titilagarh by way of a fresh representation ventilating their grievances within ten days from today and the Tahasildar, Titilagarh shall take appropriate action and dispose of the representation to be filed by the Petitioners, if there is any encroachment as alleged by the Petitioners within one month from the date of filing of the representation.

Accordingly, the Writ Petition is disposed.
