02. 1. The writ petition said to be carrying public cause (PIL) was

moved on 29^th January, 2025. Paragraphs 1 and 2 from order made that day are reproduced below.

“1. Ms. Mishra, learned advocate appears on behalf of petitioners and submits, her clients are distressed by posting of opposite party no.3 at Dibyasingha Nodal UPS. He was removed from there in consequence of allegations of possessing loose character. On query made she submits, the earlier transfer order her clients were unable to obtain and disclose.

2. Mr. Kar, learned advocate, Government Pleader appears on behalf of State. He is requested to produce the transfer order in respect of opposite party no.3 issued earlier moving him out.”

2. Mr. Kar produces office order dated 22^nd February, 2014 directing, inter alia, transfer of opposite party no.3 from Dibyasingha Nodal U.P. School to Talia Jenasahi new PPS. On perusal of subsequent transfer order dated 31^st July, 2023 (annexure-4) it appears, for administrative purposes opposite party no.3 has been transferred back to Dibyasingha Nodal UPS. Text of said transfer order is

reproduced below.

“In Samagra Sikshya CRCC plays a vital role for implementation of different activities in field level. As per the guideline CRCC have to be in the cluster school for better implementation of the project work at field level. Hence Sri Sarat Chandra Sahoo, CRCC, Swastrije NUPS, Palatpur is hereby directed to discharge his duty at Chasakhanda PUPS instead of Dibyasingha NUPS and Sri Susant Kumar Nayak, CRCC, Dibyasingha Nodal UPS Cluster is hereby directed to discharge his duty at Dibyasingha Nodal UPS instead of Bhanra PPS till further order.”

3. On observation made that State, on notice of the writ petition containing allegations therein, has produced the earlier transfer order

allegations, Miss Mishra submits, her clients’ representation dated 2^nd November, 2024 be directed to be considered.

4. We will not make any such direction because serious allegation made in the petition is supported by a representation made more than one year after opposite party no.3 was transferred back to Dibyasingha

5. The writ petition is dismissed.
