1 . This matter is taken up through hybrid arrangement.

2 . The Petitioner has filed this Writ Petition seeking a direction from this Court to the Opposite Parties not to evict him from the Plot No.117, Khata No.276, MouzaAiginia, Bhubaneswar.

3 . At the outset, learned counsel for the Opposite Party No.2/BMC submits that neither any BMC Officer/ BDA Officer has visited the house of the petitioner nor

Looking to the factual scenario of the case and considering the submission made on behalf of the Petitioner, this Court finds that the Petitioner has filed this Writ Petition only apprehending the danger of eviction/demolition of his structure standing over the disputed property in question. It further appears that no such order of eviction has been issued to the Petitioner till today. Hence, the prayer of the Petitioner made in this Writ Petition is premature.

5. At this juncture, considering the further submission made on behalf of the Petitioner, this Court grants liberty to the Petitioner to file an appropriate application for redressal of his grievance as and when the cause of action will arise.

6. Accordingly, the Writ Petition stands disposed of.
