Challenging the interim order dated 06.12.2024 passed in PLA Case No.93 of 2023 by the Chairperson, P.L.A(PUS), Puri under Annexure-4, the Petitioner has approached this Court by way of filing this writ petition invoking extra-ordinary jurisdiction under Articles 226 & 227 of the Constitution of India with the following prayer(s):-

“It is, therefore, most respectfully prayed that this Hon’ble Court may graciously be pleased to direct the Opp. Parties to receive the current bill amount of Rs.55,000/- through suitable monthly instalments and upon receipt of the 1^st instalment, restore the electricity connection forthwith and direct the learned PLA, Puri to dispose of the PLA Case No.93/2023 within a stipulated time as this Hon’ble Court may deem just and proper in the facts and circumstances of this case;

And this Hon’ble Court be pleased to pass any order/orders, direction/directions as may be deem, just and proper;

And for the same act of kindness, the petitioner, as in duty bound, shall ever pray.”

Learned counsel appearing for the Petitioner drew attention of this Court to the impugned order dated 06.12.2024 passed in PLA Case No.93 of 2023 by the Chairperson, P.L.A. (PUS), Puri under Annexure-4, which reflects as follows:-

“This order arises out of an interim petition filed by the Learned Counsel on behalf of the petitioner with a prayer to direct the Opposite Parties to restore the power supply to the house of the applicant. In the above submission, perused the Case Record & it is found that a huge amount of arrear of Rs.2,42,693.94p. is pending against the petitioner. In the above circumstances, the petitioner is directed to pay the current bill amount of Rs.55,000/- out of the total arrear amount & submit the payment receipt before its forum. Thereafter, the petition for restoration of electricity shall be considered. Put up on 09.12.2024 for Submission of payment Receipt by the applicant.”

3.1. The learned Counsel sought to press for issue of a direction to the learned Permanent Lok Adalat (PUS), Puri for disposal of said PLA Case No.93 of 2023 within a stipulated time. He further insisted for a direction for fixing suitable monthly instalments for depositing the amount (current bill amount) to be paid out of the total outstanding electricity charges.

Vehemently opposing such prayer(s), Mr. Lalit Kumar Maharana, learned counsel appearing for the opposite party No.1 submitted that the petitioner having not complied with the interim direction of the learned Permanent Lok Adalat could not make a prayer for early disposal of the case pending before him.

In view of the above submissions made by the learned counsel, this Court is not inclined to entertain this writ petition. However, since the learned Permanent Lok Adalat has directed the Petitioner for payment of current bill amount of Rs.55,000/- out of the total arrear

amount of Rs.2,42,693.94p. on consideration of interim petition pending PLA Case No.93 of 2023, this Court, without expressing opinion on the merit of the matter, disposes of this writ petition with liberty to the Petitioner to move appropriate application before the said learned Permanent Lok Adalat for consideration of instalments. In the event such application is moved, the same shall be considered on its own merit. The learned Permanent Lok Adalat may make an endeavour to dispose of the said PLA Case No.93 of 2023 as expeditiously as possible after compliance of the interim directions by the petitioner.
