Heard learned counsel for the Petitioner as well as learned counsel for the State-Opposite Party No.2. Perused the writ application as well as the documents annexed thereto.

The Petitioner has filed the present writ application with the following prayer:

“In the aforesaid facts and circumstances, it is humbly prayed that this

Hon'ble Court may be graciously pleased to:

i) quash Annexure-2, the transfer order,

¶23

ii) direct the opposite parties to allow the present petitioner to continue in the present place of his posting that is at Baripada Odisha Gramya Bank Branch RO;

iii) direct the opposite parties to show cause that a Driver of the Bank in what circumstances is being transferred to a distance of three hundred kilo meters as Office Attandant;

iv) issue notice to the opposite parties to show cause before the Hon'ble Court that by suppressing the transfer policy of their own Bank how they are transferring an employee in the mid of an academy session to a far-flung area from his present place of posting;

v) pass such other or further orders as this Hon’ble Court may deem fit and proper.”

It is stated by learned counsel for the Petitioner that the Petitioner being aggrieved by a mid-academic session transfer vide order dated 06.11.2024, whereby the Petitioner had been transferred from Baripada to Dhenkanal, has approached this Court with a prayer to quash the aforesaid transfer order. He further contended that the aforesaid transfer order is not conformity the transfer policy of the Bank which prohibits any mid-academic session transfer on routine basis. Learned counsel for the Petitioner further referring to the transfer order under Annexure-2 to the writ petition, contended that the same is not any administrative ground. Learned counsel for the Petitioner further contended that the Petitioner has not paid his arrear salaries.

Learned counsel for the Bank on the other hand contended that the Petitioner has already approached the Bank Authority by filing a representation on 12.12.2024 under Annexure-3 to the writ petition. He further submitted that since the Petitioner is on sick leave, he has not been relieved in the meantime. He further contended that in the

event this Court directs the Opposite Party No.2 to consider the representation of the Petitioner, if any, the Opposite Party No.2 shall do the same in accordance with law within a stipulated period of time.

Considering the submissions made by the learned counsels appearing for the respective parties, on a careful analysis of their submission and on a close scrutiny of the document annexed to the writ petition, this Court deems it proper to dispose of the writ petition by granting liberty to the Petitioner to file a fresh representation before the Opposite Party No.2 taking therein all the grounds along with all supporting documents within a period of one week. The Opposite Party No.2 shall do well to consider and dispose of the representation of the Petitioner by passing a speaking and reasoned order within a period of three months in accordance with law from the date of communicated of a certified copy of today’s order along with his representation. The final decision so taken be communicated to the Petitioner within ten days thereafter. It is further directed that in the event the Petitioner has not relieved from his present place of posting, he shall not be relieved from such post for a period of four months.

With the aforesaid observations/directions, the writ application stands disposed of.
