1. This matter is taken up through hybrid mode.

This I.A. has been filed by the petitioner praying for withdrawal of the writ petition vide W.P.(C) No.19014 of 2016 in order to prosecute the suit vide C.S. No.820 of 2022 pending before the court of learned 1^st Additional Civil Judge(Sr. Division), Cuttack in respect of the case land.

Heard from the learned counsel for the petitioner and learned Additional Standing Counsel for the State.

After taking into consideration to the submissions of the learned counsels of both the sides, I find no justification to disallow the prayer for withdrawal of the

writ petition vide W.P.(C) No.19014 of 2016 of the writ petitioner. Therefore, accepting the prayer of the petitioner for withdrawal of the writ petition vide W.P.(C) No.19014 of 2016, it is felt proper to dispose of the writ petition vide W.P.(C) No.19014 of 2016 as withdrawn giving liberty to the petitioner to prosecute the pending suit vide C.S. No.820 of 2022 in the court of the learned 1^st Additional Civil Judge(Sr. Division), Cuttack in respect of the case land.

Accordingly, the writ petition is disposed of finally.

Due to final disposal of this writ petition as withdrawn, the interim order, which was continuing in the writ petition are terminated automatically.
