The Petitioner in this writ petition seeks to assail the order passed by the Tahasildar, Kalahandi in settlement of nazul land in Nazul Land Case No.17 of 2023 and consequent approval by the concerned Sub-Collector, Settlement, Bhawanipatna.

Mr. Panda, learned counsel appearing along with Mr. Sahu, learned counsel for the Petitioner submits that the Petitioner has a remedy of Appeal under Section 7 (1)(b) of the Odisha Government Land Settlement Act, 1962. Hence, he

prays for withdrawal of the writ petition to avail the statutory remedy.

Mr. Mohapatra, learned Senior Advocate appearing for Opposite Party Nos.4 and 7 does not have any objection to the same.

Hence, the writ petition is disposed of as withdrawn with an observation that the Petitioner may avail the statutory remedy in accordance with law. If any Appeal is filed, the Appellate Authority while considering the plea for condonation of delay, may take into consideration the pendency of the writ petition before this Court from 15^th January, 2025 till date along with other grounds, if any, taken by the Petitioner.
