is kept in abeyance as no decision has been taken thereupon, the petitioner approached this Court with the instant writ petition which appeared on the last occasion that when the attention of this Court was drawn that there has been a huge accumulation of the excise duty and the fine amounting to Rs.10,27,757/- for the financial year 2024-25.

2. It was thus submitted that unless the amount is paid, it is not obligatory on the part of the authority to process the said application. By an order dated 16^th July, 2025 the petitioner was granted liberty to deposit the said amount within the time stipulated therein and the matter was directed to be listed today.

3. It is submitted by Mr. Biraja Prasanna Das, learned counsel appearing on behalf of the petitioner that the said amount has already been deposited and the offline challan generated after receipt of the amount would corroborate the same.

Mrs. Suman Pattanayak, learned Additional Government Advocate (AGA), appearing on behalf of the opposite parties-State hands over a written instruction which she received from the Superintendent of Excise, Cuttack which also corroborates that the aforesaid amount has been deposited by the petitioner but a further demand towards the license fee from January, 2025 to March, 2025 was raised and according to her, unless the same is deposited, the application cannot be processed for the financial year 2025-26.

5. We find that the application was filed much earlier and if

the proposed site is approved, there is no difficulty on the part of the

petitioner to pay the license fee. The authorities cannot keep the application in suspended animation nor are permitted to enlarge the demand on each date when the matter is listed. On the last date, the amount due was quantified which was directed to be paid by the petitioner and the same in fact has been paid. We thus do not think that the further demand should stand on the way of consideration of the application filed by the petitioner.

6. We, therefore, dispose of the instant writ petition directing opposite party No.2, i.e., the Excise Commissioner, Odisha to consider the application filed by the petitioner within a period of three weeks from the date of communication of this order. In the

event, the said authority proposed to allow the application, all consequential steps shall be taken by the respective authorities within three weeks from the date of such order.
