As directed, learned State counsel has obtained written instructions from the DSWO, Subarnapur inter alia stating as follows:

“As per Department letter no. 4062 dtd 03.03.2020, 50% (Fifty percent) of the total number of posts in the cadre of Supervisor shall be filled up from among Anganwadi Workers of the District. Further Women and Child Development Deptt. Odisha, the sanctioned strength of Supervisor in Subarnapur District is 60. Accordingly 30 nos. of post should be filled up by the selection from among Anganwadi Worker to the post of Supervisor on promotion. However in Subarnapur District already 36 nos. of Supervisors are in position who are promoted from Anganwadi Worker. Hence there is no scope to give further promotion from Anganwadi Worker to the post of Supervisor in Subarnapur District. (Copy of Present position of Supervisor enclosed as Annexure-6)”.

Since it is stated that presently there are no available vacancies, no direction can be issued to the authorities to promote

the petitioners to the post of Lady Supervisor. However, in view of the fact that there is nothing on record to show that the petitioners are otherwise not ineligible for the promotional post, the writ application is disposed of with the observation that in case any future vacancy arise, the case of the petitioners shall be considered in accordance with law.
