The petitioner was a passport holder, the validity of which having expired, he sought for its renewal. By order dated 21.05.2024, the passport authority rejected his application for renewal on the ground that three criminal cases are pending against him

In course of hearing, Mr. A. Pal, learned counsel for the petitioner submits that out of the three cases mentioned in the impugned order, the petitioner has already been acquitted in one namely, Bhawanipatna P.S. Case No.248 of 2016. The petitioner has filed an affidavit enclosing copy of the judgment of acquittal passed in the said case. Insofar as the remaining cases are concerned, Mr. Pal submits that the said cases are pending.

Mr. Parhi, learned DSGI submits that in view of the pendency of criminal cases against the petitioner he needs to obtain no

objection certificate from the concerned criminal Courts in terms of the Government of India Notification No.GSR 570(E) dated 25.08.1993.

Having regard to the submissions as above as also the materials on record, the writ application is disposed of granting liberty to the petitioner to approach the concerned criminal Courts seeking grant of NOC by making necessary application.

If such motion is made, the concerned Courts shall consider the application having due regard to the Government of India notification referred above and pass necessary orders as early as possible.

It goes without saying that, if the NOC is granted by the Courts below, the petitioner may submit the same before the Passport Authority along with his application for renewal.
