2 . In filing this Writ Petition, the Petitioner has made the

following prayer:-

“ Under the above facts and circumstances it is humbly prayed that your Lordships would graciously be pleased to direct the Opposite Parties No.-3 and 4 it to release the Hywa Vehicle bearing Registration No.-OD01AL4279, TATA Motors, SIGNA4825TK goods caring vehicle bearing Engine and Chechis No.B6.786A250D02112D64151308 & MAT808017M3D08949 in favour of the Petitioner which has been kept under the custody of Op No-4 basing upon the report of the Op No-3 since 04.01.2025. for the interest of justice; and pass only other direction(s), or order(s) as deemed mote and proper in the interest of justice;

4 . Learned counsel for the State, at the outset, submits that in or der to redress his grievance the Petitioner instead of preferring this Writ Petition, should have approached the

concerned Magistrate as per the provision under Section 503 of the Bharatiya Nyaya Sanhita.

In such view of the matter, this Court directs the Petitioner to file an appropriate application as per the provision under Section 503 of the Bharatiya Nyaya Sanhita before the concerned Magistrate within a period of fifteen working days hence. In such event, the said application at the instance of the Petitioner shall be disposed of by passing a lawful order within a period of one month thereafter.
