Learned counsel for the State has produced the letter no.3519 dated 09.04.2018 of the Govt. of Odisha, Law Department, wherein it is stated that the appellant Sukra Khora has been released prematurely in exercise of the powers conferred by section 432 of Cr.P.C. (473 of BNSS) by remitting the unexpired portion of the sentence passed in the impugned judgment and order dated 06.01.2007 by the learned Addl. Sessions Judge, Malkangiri in Criminal Trial No.15 of 2003. The letter is taken on record.

The learned Sessions Judge, Malkangiri submitted a letter dated 16.04.2025 through the Registrar (Judicial)

regarding premature release of the appellant in view of the letter no.(IV-J-16/2018) 3519 dated 09.04.2018 of Law Department, Govt. of Odisha, which is taken on record.

In view of letters produced by the learned Sessions Judge, Malkangiri and learned counsel for the State, the JCRLA stands disposed of.

The personal appearance of Senior Superintendent, Circle Jail, Koraput is dispensed with.

It is brought to the notice of this Court that some of the cases, the convicts, who have been sentenced to life imprisonment, have been released prematurely by the Govt. in exercise of the power under section 432 of Cr.P.C. (473 of BNSS) or dead.

List of such pending cases, in which the convicts have been released prematurely or died, be called for from the each of the jail throughout the State.

A copy of the order be communicated to the D.G. of Prisons, Odisha, who shall do the needful and the D.G. of Prisons, Odisha shall communicate the list of pending cases in which the convicts have been released prematurely or died to the Registrar (Judicial) of this Court.
