Heard Mr. Panda, learned counsel for the petitioner and Mr. Mohapatra, learned AGA for the State.

Instant revision is filed by the petitioner assailing the impugned order dated 30^th June, 2025 as at Annexure-1 passed in connection with T.R. Case No.03 of 2022 by learned Additional District and Sessions Judge-cum-Special Judge, Nabarangpur corresponding to C.T. Case No.03 of 2021(J) arising out of Kodinga P.S. Case No.211 of 2021, whereby, an application under Section 311 Cr.P.C. read with Section 438 BNSS seeking recall of the informant and her parents moved by him was rejected.

In course of hearing, Mr. Panda, learned counsel for the petitioner submits that the petitioner should be granted the liberty to file a better application before the learned court below

demanding such recall of the witnesses including opposite party No.2.

Recorded the submission of Mr. Mohapatra, learned AGA for the State.

Since such a request is received from the side of the petitioner, the Court is inclined to direct him to file a fresh application under Section 311 Cr.P.C. read with Section 438 BNSS with the questionnaire therein for consideration of the learned court below on merit and according to law.

6. Hence, it is ordered.

In the result, the revision petition stands disposed of granting the liberty in favour of the petitioner once again to approach the learned court below in the light of the direction as aforesaid.
