1. Heard learned counsel for the Parties.

By means of this application, the Petitioner seeks the intervention of this Court for a direction to the Opposite Party No.3 for a fair investigation.

Learned counsel for the State, on the other hand, has placed the written instruction of the IIC, Marshaghai P.S., wherein it is disclosed that the complaint of the Petitioner having registered in connection with the Marshaghai P.S. Case No.316 of 2025 under Sections 85/80/103(1)/3(5) BNS, r/w. Section 4 of D.P. Act. The investigation has already commenced. In course of the investigation, the complainant has been examined, other witnesses have also

been examined and their statements have been recorded, requisition has been sent to the Sub-Collector, Kendrapara to depute Executive Magistrate to remain present during the inquest of the dead body of the deceased, incriminating materials have been seized, inquest was done, body was dispatched for identification. As prima facie evidence was made out under Sections 85/80/103(1)/3(5) BNS, r/w. Section 4 D.P. Act, the accused person namely Rajkumar Lenka was arrested. Post-mortem report in respect of the post-mortem conducted on the dead body of the deceased was obtained, the cause of death as opined by the doctor is asphyxia as a result of ante-mortem hanging.

In view of the aforesaid instructions submitted, it is expected that the investigating agency shall expedite the process of the investigation and submit the Final Form, if any, within a period of one month, if there be no other legal impediment.

The CRLMP stands disposed of accordingly.
