State of Odisha & another, CRLMP No. 1321 of 2025 (High Court of Orissa at Cuttack, Chittaranjan Dash, J., order dated 20.11.2025): On a petition seeking a direction to the Superintendent of Police, Economic Offences Wing, Bhubaneswar for a proper and fair investigation and arrest of the accused persons, the Court took on record the written instructions of the SP disclosing that the Economic Offences Wing, CID-CB, Bhubaneswar had initiated an enquiry on the complaint, pending analysis awaiting bank and other documents, and that the complainant was not cooperating by supplying required documents. The Court directed the SP, EOW to ensure the enquiry is completed within a reasonable time, not later than one month, if there be no other legal impediment, and observed that the SP may direct examination of the complaint and, if a cognizable offence is made out, register an FIR and proceed with investigation in accordance with law. 1. Heard learned counsel for the Parties.

By means of this application, the Petitioner seeks the intervention of this Court for a direction to the Opposite Party No.2, to conduct a proper and fair investigation and to arrest the accused persons in connection with the allegations.

Learned counsel for the State, on the other hand, has placed the written instructions of the Superintendent of Police, Economic Offences Wing, Bhubaneswar, wherein it is disclosed that the Economic Offences Wing, CID-CB, Bhubaneswar, upon receipt of the complaint, initiated an enquiry and the same is pending for analysis awaiting the bank documents and other documents; it is also disclosed in

the instructions that the complainant is not cooperating the police by supplying the required documents.

The written instructions submitted by the Economic Offences Wing, CID-CB, Bhubaneswar, is taken on record.

Keeping in view the aforesaid instructions, it is directed that the Opposite Party No.2, i.e. Superintendent of Police, Economic Offences Wing, Bhubaneswar, shall do well to ensure that the enquiry is completed within a reasonable time, if there be no other legal impediment not later than one month. The Superintendent of Police, however, may pass appropriate direction to examine the complaint and in the event a cognizable offence is made out therefrom to register the same as FIR and proceed with the investigation in accordance with law.
