1. This matter is taken up through Hybrid Arrangement (Virtual /Physical Mode).

Heard learned counsel for the Petitioners as well as the learned Additional Standing Counsel. Perused the Application as well as the documents annexed thereto.

By filing the present application under section 482 Cr.P.C., the Petitioners seek to invoke the inherent jurisdiction of this Court to quash the entire criminal proceeding in G.R.Case No.1245 of 2015 which

corresponding to Balianta P.S.Case No.299 of 2015 pending in the Court of the learned J.M.F.C.(O), Bhubaneswar.

The aforesaid case was registered on the basis of the F.I.R. lodged by one Patamani Panda alleging torture and harassment by her own family members. Learned counsel for the Petitioners contended that since there exists a Civil Proceeding amongst the family members, the present F.I.R. has been registered making false allegation implicating the Petitioners. On such ground, learned counsel for the Petitioners contended that in the event the trial is allowed, the same would not yield any result since the ultimate chance of conviction is very bleak.

Learned Additional Government Advocate on the other hand contended that although the informant has died in the meantime, however there are other witnesses, who have witnessed the occurrence and they have stated before the Police regarding the allegations made in the F.I.R. As such learned Additional Government Advocate contended that it will be premature to quash the proceeding in this case.

Having heard learned counsels for the respective parties, on careful examination of the documents attached to this case, this Court observes that the case is of the year 2015 and the case is lingering. Without going into the merits of the matter, this CRLMC is disposed of directing the learned trial court to expedite the trial and the trial court shall make every endeavour to conclude the trial within

three months. The Petitioners are directed to cooperate with the trial court for earlier conclusion of trial.

With the aforesaid observation, the CRLMC stands disposed of.
