1. This matter is taken up through Hybrid Arrangement (Virtual /Physical Mode).

Heard learned counsel for the Petitioner as well as learned counsel for the Vigilance Department. Perused the application as well as the documents annexed thereto.

On a careful scrutiny of the prayer it appears that the Petitioner has approached this Court by invoking the inherent power for a direction to the trial court to quash the entire criminal proceeding in Bhawanipatna G.R Case (Vigilance) No.15 of 2014 arising out of Koraput Vigilance P.S Case No.30 of 2014 pending in the court of the learned Special Judge, Vigilance, Bhawanipatna.

contended that although the Petitioner has approached this Court by filing the present application with a prayer for quashing of the entire criminal proceeding on the ground that the Petitioner, who happens to be the wife of the principal accused, could not have been implicated with the aid of section 109. However, he does not want to press this application, if this Court directs the learned trial court to expedite the trial and conclude the same in a time bound manner.

Learned Standing Counsel for the Vigilance Department on the other hand contended that the trial is continuing at the moment. Therefore, this Court should not entertain the present application of the Petitioner. It was also contended that out of 41 prosecution witnesses, 20 witnesses have been examined so far.

Taking into consideration the fact that the case is of the year 2014, this court deems it proper to dispose of the present application by directing the learned trial court to expedite the trial and make every endeavour to conclude the same as expeditiously as possible preferably within a period of one year from the date of communication of a certified copy of today’s order.

With the aforesaid observations/ directions, the CRLMC stands disposed of.
