1. In the present petition, the petitioner is seeking quashing of the entire criminal prosecution arising out of the F.I.R. in connection with Barbil P.S. Case No.255 of 2021 corresponding to G.R. Case No.858 of 2021 registered for the alleged commission of the offences punishable under Sections 353/ 307/398 of the IPC pending in the Court of the learned J.M.F.C., Barbil on various grounds.

2. The investigation in the present case is still going on. At the stage of investigation, the petitioner had approached this Court by filing ABLAPL No.3580 of

The Coordinate Bench of this Court vide order dated 18.05.2022 has although dismissed the anticipatory bail application, however, granted liberty to the petitioner to appear before the Court below and resort to the remedy available to him under law. The operative part of the said order is reproduced under:

“Considering the nature and gravity of the

accusations against the petitioners, while not inclining to grant anticipatory bail to the petitioners, liberty is granted to them to surrender and move for bail in the Court below within a period of four weeks from today in the event of which the learned Courts below shall dispose of the same in accordance with law expeditiously and the claim of parity with the co-accused, who is stated to have been released on bail, shall be taken into account in accordance with law. The case records shall be made available to the Courts concerned for disposal of the bail application.”

3. Learned counsel for the petitioner seeks to withdraw the present petition so as to avail the benefit of the order dated 18.05.2022 passed by the Coordinate Bench of this Court in ABLAPL No.3580 of 2022.

4. Learned counsel for the petitioner submits that his client would be appearing/surrendering before the trial Court on or before 05.05.2025 by availing the benefit of the order dated 18.05.2022.
