1. This matter is taken up through Hybrid Arrangement (Virtual /Physical Mode).

Heard learned counsel for the petitioner as well as learned counsel appearing for the Informant and learned counsel for the State.

The present application has been filed with a prayer for modification of common order dated 10.07.2025.

Learned counsel for the Petitioners at the outset contended that on the basis of the compromise arrived at between the parties the non-compoundable offences alleged against the Petitioners have been quashed. He further submitted that in Para-9 of the order in the 5^th line the offences under Section 351(2) and 331(4) of the B.N.S. have been left out after mentioning Section 109 of the B.N.S. He

further contended that the offences under Section 351(2) and 331(4) of the B.N.S. are non-compoundable in nature. Since the entire dispute has been settled on compromise and the offence in both the cases, so far as it concerns the non-compoundable offences are quashed, the order dated 10.07.2025 be modified to the extent that in the 5^th line after “Section 109”, the “Section 351(2) and 331(4)” be added.

Learned counsels for the Opposite Parties have no objection to the same.

Accordingly, the prayer for modification is allowed. Accordingly, “Section 351(2) and 331(4)” be added after “Section 109” in the 5^th line of Para-9 of the order.

In view of such modification, the time to surrender of the Petitioner before the Court below is extended to another four weeks from today subject to depositing cost of Rs.1000/- (Rupees One Thousand) in the Advocates’ Welfare Fund of Orissa High Court Bar Association within fifteen days and furnishing money receipt thereof in proof of deposit.

It is made clear that, if the cost is not deposited within the stipulated time, time extended for the petitioner to surrender shall stand revoked automatically.

Accordingly, the I.A. stands disposed of.
