1. This matter is taken up through hybrid arrangement. 2. This CONTC arises out of the order dated 01.07.2024 passed by this Court in W.P(C) No.38407 of 2023.

3. Heard learned counsel for the Petitioners and learned counsel for the Opposite Parties.

4. This Court vide order dated 20.05.2024 in W.P.(C) No.38407 of 2023 has directed as follows:-

guarantee given by the Petitioner vide letter dated 29.12.2023 has already expired since 30^th April, 2024.

In such view of the matter, this Court permits the Petitioner to approach the concerned Bank authorities for extension of the period of the said Bank guarantee for another six months from 30^th April, 2024. The Opposite Party Nos.2 to 4 are also directed to make a communication in that regard to the concerned Bank authorities.

4. It is also directed that upon getting such communication the Bank authorities shall extend the period of the said Bank guarantee for another six months from 30^th April, 2024.

5. Learned counsel for the Opposite Party Nos.2 to 4 is also directed to submit the details of the Bank guarantees given by the present Petitioner and lying before the different Banks, on the next date.

6. List this matter on 27^th June, 2024.

7. Interim order passed earlier shall continue till the next date.”

At the outset, learned counsel for the Opposite Party/ Contemnor brings to the notice of this Court to the order dated 21.03.2025 passed by the National Company Law Tribunal, Kolkata Bench, Kolkata in IA (I.B.C)/395 (KB) 2024 arising out of C.P. (IB)/ 148 (KB) 2018 and submits that extension of the period

submits that the Petitioner was a party to the said NCLT proceeding, yet he has not intimated this Court about such facts. Hence, this Court passed the order dated 20.05.2024 in W.P.(C) No.38407 of 2023 allowing the extension of bank guarantee.

6. In such view of the matter, the Contemnor cannot be faulted with.

7. The CONTC is, accordingly, disposed of being dropped.
