Contempt petition (CONTC No.3408 of 2025) against the Sub-Registrar, Kukudakhandi, Ganjam for alleged non-compliance with this Court's directions in W.P.(C) No.12192 of 2025 to register the Petitioner's deed for sale said to have been presented on 07.04.2025. The alleged contemnor denied receipt of any deed on that date, and counsel for the Petitioner conceded that although the deed was executed with E-Stamping, no registration slot had been booked. In view of these submissions, the Court dropped the contempt petition, gave the Petitioner liberty to book a fresh slot by creating a new I.D. and to present the sale deed, and directed the Sub-Registrar to act thereon as per the Indian Registration Act, 1908 and the Orissa Registration Rules, 1988. Petition disposed of finally.

This contempt petition was filed by the Petitioner due to non-compliance of the directions of this Court by the Sub-Registrar, Kukudakhandi, Ganjam passed in W.P.(C) No.12192 of 2025.

In the order passed in W.P.(C) No.12192 of 2025, the Sub-Registrar, Kukudakhandi, Ganjam was directed to register the deed for sale, which was presented by the Petitioner before the Sub-Registrar, Kukudakhandi, Ganjam on dated 07.04.2025.

The alleged contemnor submitted show cause through the learned standing counsel for the State stating that, no deed was presented by the Petitioner on dated 07.04.2025 before him, for which, the question of denial to receive the same by the Sub-Registrar, Kukudakhandi, Ganjam for registration does not arise.

The learned counsel for the Petitioner submitted that, on dated 07.04.2025, though, the deed was executed for sale with E-Stamping by the Petitioner, but, no slot was booked for its registration.

As per the prevailing practice, the slot is to be booked first and thereafter on the basis of the serial number of the slot booking, the deed is to be registered.

When, it is the submissions of the learned counsel for the Petitioner that, no slot for registration was booked on 07.04.2025 and when directions was given in the order of W.P.(C) No.12192 of 2025 for registration of the deed for sale of the Petitioner, then, by taking into account to the submissions of the learned counsels of both the sides, it if felt proper to drop this contempt petition filed by the Petitioner giving liberty to the petitioner to book the slot creating a new I.D. and to present the sale deed before the Sub-Registrar, Kukudakhandi, Ganjam to register the sale deed on that basis and thereafter, the Sub-Registrar, Kukudakhandi, Ganjam shall act upon the same as per the Indian Registration Act, 1908 and the Orissa Registration Rules, 1988.
