However, taking into consideration that the Petitioner/Defendant No.6 is about 82 years old, as submitted by learned counsel for the Petitioner, this Court disposes of the CMP with a direction that in the event, the Petitioner files a petition for early disposal of the suit, learned trial Court shall do well to pass necessary orders on such application as expeditiously as possible, preferably within a period of two weeks from the date of filing of such application and proceed with the suit accordingly, if there is no legal impediment.
