The certified copy having been produced in the Court below, the Court directed that the petitioner Praveen Chandra Bhanjdeo be permitted to inspect it, either in person or through his lawyer, in accordance with law, in the presence of the Sheristadar on the date fixed. As injunction orders restraining alienation or change of nature and character of the suit property had already been passed in earlier CMPs and both parties agreed to abide by them, the Court declined to pass any fresh restraint order and merely reiterated that the parties shall abide by their undertakings submitted in terms of those orders.

Heard Mr. B. Bhuyan, learned senior counsel with Mr. S.S. Bhuyan, learned counsel appearing for the petitioner and Mr. K. Chowdhury, learned counsel appearing for the Opposite Party No.1.

The CMP involves challenge to order dated 29.10.2024 passed by the learned Civil Judge (Senior Division), Baripada, whereby the Opposite Party No.1 was directed to produce certified copy of the alleged registered will before the Court. Pursuant to such order, the Opposite Party No.1 has produced the certified copy of the will in the Court below. The petitioner has filed an application for permission to inspect the certified copy of the will so produced by the Opposite Party No.1.

The matter stands posted to 29^th of this month for filing of objection by Opposite Party No.1 and hearing on the petition.

In course of hearing, Mr. Chowdhury submits that the certified copy of the will having been produced, his client would have no objection if the petitioner inspects the will but he should be restrained from taking any coercive steps with regard to the suit property. To this, Mr. Bhuyan, learned senior counsel would submit that there are orders of injunction passed by this Court in earlier CMPs restraining the parties from alienating or changing the nature and character of the suit property during pendency of the suit.

Since orders of restraint have already been passed by this Court to which both parties agree to abide by, this Court does not find it necessary to pass any further order except for reiterating that the parties shall abide by their undertakings submitted before this Court in terms of the orders of restraint passed in the earlier CMPs.

The CMP is therefore, disposed of directing the Court below to permit the petitioner-Praveen Chandra Bhanjdeo to inspect the certified copy of the will produced by Opposite Party No.1(Prativa Manjari Devi) in Court either himself or through his lawyer in accordance with law. Such inspection shall be made in presence of the Sheristadar of the said Court on the date fixed.
