Saroj Kumar Panda Vs State of Odisha

The petitioner is in custody in connection with EOW Bhubaneswar P.S. Case No. 09 of 2023 corresponding to T.R. Case No. 02 of 2023 pending in the Court of learned Designated Court under OPID Act, Cuttack for the alleged commission of offence under Sections 420/467/468/120-B IPC and Section 6 of OPID Act.

He was granted interim bail by orders dated 15.05.2024 and 12.11.2024. As directed by this Court he deposited three demand drafts each of Rs.50,000/- in the court below. It was further directed that during the period of his interim bail he shall make endeavour to pay further amount to the informants and deposit the same in the court below.

Learned counsel appearing for the petitioner submits that the petitioner could not comply with the above condition as he was taken on remand in connection with another case. However, he

submits that the co-accused persons have already paid Rs.15 lakhs to the informants and he himself has paid Rs.1.5 lakhs. If he is released from custody, he can make endeavour to arrange further amount for depositing before the trial court.

Mr. Patra, learned counsel appearing for the OPID opposes the prayer for bail by submitting that a strong prima facie case exists against the petitioner and moreover he is involved in eleven similar cases. He however, fairly concedes that the petitioner has in fact paid Rs.1,50,000/- as undertaken by him.

Taking into consideration all the above facts and particularly the fact that the petitioner has paid Rs.1.5 lakhs as directed by this Court, while directing his release on interim bail and his detention does not appear to be necessary for further investigation, a lenient view can be taken.

Let the petitioner be released on bail on such terms and conditions as the court below may deem fit and proper to impose including the following conditions:-

i. He shall deposit Rs.1,50,000/- in the Court below within three months from today failing which it shall be open to the prosecution to seek cancellation of the bail by making appropriate application before the trial court. ii. Further the petitioner shall make endeavor to deposit the remaining amount to each of the informants as undertaken by him under paragraph-8 of the affidavit filed before this Court by the end of December, 2025.

The BLAPL is accordingly disposed of.
