This matter is taken up through Hybrid Arrangement (Virtual/Physical Mode).

This is a bail application U/S.483 of BNSS by the petitioner for grant of bail in connection with Jagatpur P.S. Case No.630 of 2023 corresponding to Spl. G.R. Case No.204 of 2023 pending in the file of learned Addl. Sessions Judge-cum-Special Court under POCSO Act, Cuttack, for commission of offences punishable U/Ss. 302/377 of the IPC r/w. Section 6 of the POCSO Act, on the main allegation of committing murder of the deceased-child by having unnatural sex and committing aggravated penetrative sexual assault upon him.

Heard, Mr. Himanshu Bhusan Dash, learned counsel for the petitioner and Mr. P. Satpathy, learned Addl. PP in the matter and perused the record. None appears for the informant despite being duly informed as intimated by the State.

After having considered the rival submission and taking into consideration the nature and gravity of the offences as alleged against the petitioner vis-àvis the allegations sought to be brought against him and taking into account the materials collected in support thereof and regard being had to the role as alleged against the petitioner and on going through the other materials placed on record, this Court does not consider it proper to grant bail to the petitioner.

Hence, the prayer for bail of the petitioner stands rejected. Accordingly, the BLAPL stands disposed of.
