Since these four bail applications arise out of one and same case record, the same are heard together and disposed of by this common order with the consent of the learned counsel for the parties.

These are the bail applications U/S.483 of BNSS by the petitioners for grant of bail in connection

with CT Case No. 266 of 2025 arising out of Air Field PS Case No. 105 of 2025 pending in the file of learned JMFC-I, Bhubaneswar for commission of offences punishable U/Ss. 103(1)/103(2)/61(2) of BNS, on the main allegation of committing murder of one Sasmit Kumar Biswal, along with co-accused persons in furtherance of their common intention.

Heard, Mr. Amlan Shakti Paul, learned counsel for the Petitioner in BLAPL No. 7721 of 2025; Mr. Laxmidhar Mahapatra, learned counsel for the Petitioner in BLAPL No. 8323 of 2025; Mr. Prasanta Kumar Nanda, learned counsel for the Petitioner in BLAPL No. 8683 of 2025; Ms. Abhilipsa Mohanty, learned counsel for the Petitioner in BLAPL No. 9645 of 2025; Mr. Bishnu Prasad Pradhan, learned counsel for the Informant and Mr. R.B. Mishra, learned Additional Public Prosecutor in these matters and perused the record.

After having considered the rival submissions upon perusal of the record, there appears some allegation against all the Petitioners except the Petitioner-Sukanta Behera @ Suka for committing murder of Sasmit Biswal by conjointly assaulting him with cudgel and bamboo stick, but it is advanced by Ms. Abhilipsa Mohanty, learned counsel for the PetitionerSilu @ Manoj Kumar Behera that there is clear discrepancies in the statement of witnesses recorded U/Ss. 180 & 183 of BNS and in the FIR lodged by the deceased against some of the accused persons does not

contain the name of petitioner-Silu @ Manoj Kumar Behera and the PM report being discrepant with allegation made by the complainant, and therefore, the benefit of doubts should enure to the benefit of Petitioner- Silu @ Manoj Kumar Behera, however, this beautiful demonstration of submission does not convince the Court and it is only recorded to reject the contention as advanced for the said Petitioner, since at the time of consideration of bail, detail analysis of evidence and meticulous examination of documents on merit should be eschewed. Further, it is also brought to the notice of the Court that the deceased had lodged an FIR against some of the petitioners and others and thereafter, the deceased was allegedly done to death. 6. In such view of the matter and taking into account the nature and gravity of the offence as alleged vis-à-vis the accusation sought to be brought against the Petitioners keeping in view the statement of eye witnesses namely Subrat Samal, Bhajendra Jena, A. Madhusudan Reddy and other witness Anjali Nayak who is the IO in the previous case instituted by the deceased and taking into account the cause of death of the deceased as opined by the Doctor in the PM report, however, there being no direct evidence against coaccused Sukanta Behera @ Suka, this Court while being inclined to grant bail to the Petitioner-Sukanta Behera @ Suka considers it not proper to grant bail to the rest of the Petitioners at this stage, especially when the eye witnesses are yet to be examined.

Hence, the bail application of the petitioner namely Sukanta Behera @ Suka in BLAPL No. 8683 of 2025 stands allowed, whereas the bail applications of the Petitioners namely Sukanta Parida @ Suka, Bulu Parida @ Debadutta Parida and Silu @ Manoj Kumar Behera in BLAPL Nos. 7721, 8323 & 9645 of 2025 stand rejected. Accordingly, only the Petitioner Sukanta Behera @ Suka is allowed to go on bail on furnishing bail bonds of Rs.25,000/- (Rupees Twenty Five) with two solvent sureties each for the like amount to the satisfaction of the learned Court in seisin of the case on such terms and conditions as deem fit and proper by it. 8. Accordingly, these BLAPL Nos. 7721, 8323, 8683 and 9645 of 2025 stand disposed of. Issue urgent certified copy of the order as per Rules.
