This matter is taken up through Hybrid Arrangement (Virtual/Physical Mode).

Since these four bail applications arise out of one and same case record, the same are heard together and disposed of by this common order with the consent of the learned counsel for the parties.

These are the bail applications U/S.483 of BNSS by the petitioners for grant of bail in connection with Machhakund PS Case No.15 of 2025 corresponding to GR Case No.7 of 2025 pending in the file of learned JMFC, Lamtaput, for commission of offences punishable U/Ss.103(2)/3(5) of BNS, on the main allegation of committing murder of one Sanai Sail by assaulting her, along with co-accused persons.

Heard, Mr. Amulya Ratna Panda, learned counsel for all the petitioners and Mr. C. Mohanty, learned Additional Public Prosecutor in the matter and perused the record including the certified copy of depositions of PWs.1 to 6.

After having considered the rival submissions and taking into consideration the nature and gravity of the offences as alleged against the petitioners vis-à-vis the accusations sought to be brought against them and regard being had to the pre-trial detention of the petitioners in custody since 14.02.2025 with examination of material witnesses PWs.1 to 6, which includes the husband and son of the deceased and they having not supported the prosecution allegation against the petitioners by deposing inter-alia that the deceased died being felled down due to ailment of sickle cell anemia and keeping in view the other circumstances on record in entirety including the inherent right of the accused to be presumed innocent until proven guilty at the trial, this Court without expressing any view on merits admits each of the petitioners to bail.

Hence, these four bail applications of the petitioners namely Krushna Sisa (In BLAPL No.5595 of 2025); Dasarathi Badanayak (In BLAPL No.5810 of 2025); Dinabandhu Sisa (In BLAPL No.5822 of 2025) and Mahendra Sisa (In BLAPL No.5825 of 2025) are allowed and each of the petitioners is allowed to go on bail on furnishing bail bonds of Rs.25,000/- (Rupees

Twenty-five Thousand) with one solvent surety for the like amount to the satisfaction of the learned Court in seisin of the case on such terms and conditions as deem fit and proper by it.
