This matter is taken up through Hybrid Arrangement (Virtual/Physical Mode).

This is the 4^th bail application U/S.483 of BNSS by the petitioner for grant of bail in connection with Bijepur PS Case No.201 of 2018 corresponding to CT Case No.15 of 2019 (GR Case No.536 of 2018) pending in the file of learned Additional Sessions Judge, Padampur, for commission of offences punishable U/Ss.450/307/302/34/120-B of IPC, on the main allegation of assisting the co-accused to commit murder of one Jayashree Meher and injuring three other persons.

Heard, Mr. Jagabandhu Sahu, learned counsel for the petitioner and Mr. C. Mohanty, learned Additional Public Prosecutor in the matter and perused the record.

Admittedly, the petitioner is in custody since 08.12.2018, but trial is yet to be concluded. In such situation and after having considered the rival submissions and taking into consideration the nature and gravity of the offences as alleged against the petitioner vis-a-vis the accusations sought to be brought against him and on going through the materials placed on record together with the evidence of material witnesses like PWs.7 to 9, this Court without expressing any opinion on merits of the case, admits the petitioner to bail.

Hence, the bail application of the petitioner stands allowed and the petitioner is allowed to go on bail on furnishing bail bonds of Rs.50,000/- (Rupees Fifty Thousand) only with one solvent surety for the like amount to the satisfaction of the learned Court in seisin of the case on such terms and conditions as deem fit and proper by it.
