Instant petition under Section 483 BNSS is filed for release of the petitioner on bail in connection with T.R. Case No. 128 of 2024 (arising out of Koraput G.R.P.S. Case No. 29 of 2024) pending in the file of learned Additional Sessions Judge-cum-Special Judge, Koraput, on the grounds stated.

In course of hearing, it is informed to the Court by Mr. Pattnaik, learned counsel for the petitioner that the present accused is a student of Vocational Operation Theatre Technology, ODD and while claiming so, he produced a copy of the admit card issued by the Controller of Examination, COER University, Rurki. It is submitted that 21 Kgs 100 Grams of contraband Ganja was seized from the possession of the petitioner and considering his age and being a student, Mr. Pattnaik, learned counsel for the petitioner

pleads for his release, which is objected to by Mr. Jena, learned AGA for the State by claiming that commercial quantity of Ganja was recovered, as one more accused is involved, from whom, the recovery is in respect of 31 Kgs 600 Grams. The Court finds that the recovery and seizure was made by the GRPS, Rayagada. The petitioner was found staying in a lodge and thereafter, in possession of the contraband Ganja. The Court further finds that separate seizures have been made with 21 Kgs 100 Grams of Ganja shown to have been recovered from the petitioner. It is revealed from the FIR that the petitioner is an outsider belongs to the State of UP. It is claimed that the petitioner does not have any similar antecedent. Considering the objection of Mr. Jena, learned AGA for the State and the above facts and submission of Mr. Pattnaik, learned counsel appearing for the petitioner and as the petitioner is a student and a young boy aged about 24 years and was found in possession of a bag containing 21 Kgs 100 Grams of Ganja with a separate seizure made and has been in custody from 6^th December, 2024, the Court is of the view that he should be allowed to go on bail with stringent conditions.

4. Accordingly, it is ordered.

In the result, the petition under Section 483 BNSS stands allowed. Consequently, the petitioners are directed to go on bail in connection with T.R. Case No. 128 of 2024 arising out of Koraput G.R.P.S. Case No. 29 of 2024 subject to him furnishing a bail bond of Rs.50,000/- (rupees fifty thousand) with one solvent surety for the like amount to the satisfaction of the learned Additional Sessions Judge-cum-Special Judge, Koraput, who shall be at liberty to impose such other suitable conditions as deemed just and proper in the facts

and circumstances of the case besides the following, such as, he shall appear and attend the P.S. whenever directed and cooperate in the investigation without fail and at the time of release to furnish an undertaking at the local PS to not involve himself in any similar criminal activities, while on bail.

The BLAPL is disposed of.
