This matter is taken up through Hybrid Arrangement (Virtual/Physical Mode).

This is a bail application U/S.483 of the BNSS by the petitioner for grant of bail in connection with CT Case No. 09 of 2024 (Sessions) arising out of Golamunda PS Case No. 155 of 2023 pending in the Court of learned Addl. Sessions Judge-cum-Special Judge, Dharamgarh for commission of offences punishable U/Ss. 302/34 of IPC, on the main allegation of committing murder of one Kashinath Teji by assaulting him.

Heard, Mr. Debabrata Dash, learned counsel for the Petitioner and Mr. R.B. Mishra, learned Addl. Public Prosecutor in the matter and perused the record. 4. Admittedly, this Court by an order passed on 03.12.2024 in BLAPL No. 1426 of 2024 has granted liberty to the Petitioner to renew his prayer for bail after examination of witnesses Rama Chandra Teji and

Madana Teji and the Petitioner has supplied the copy of depositions of Rama Chandra Teji and Madana Teji while renewing his prayer for bail, but there is in fact serious allegation against the Petitioner for committing murder of the deceased, however, since the Petitioner is renewing his prayer for bail purportedly under the changed circumstances of examination of these two witnesses, this Court considers it proper to go through the evidence of these witnesses.

In the aforesaid backdrop and after having considered the rival submissions and on going through the evidence of the witnesses together with the evidence of Rama Chandra Teji and Madana Teji vis-àvis the allegation sought to be brought against the petitioner and taking into account the other circumstances on record in entirety, this Court finding a prima facie case against the petitioner does not consider it proper to grant him bail.

Hence, the bail application of the petitioner stands rejected. Accordingly, the BLAPL stands disposed of. 6. Issue urgent certified copy of the order as per Rules.
