This is an application under section 483 of B.N.S.S. in connection with Khuntuni P.S. Case No.60 of 2025 corresponding C.T. Case No.174 of 2025 pending in the Court of learned S.D.J.M., Athagarh Cuttack for alleged commission of offences under sections 75(1)/351(2)/296 of B.N.S.

The prayer for bail of the petitioner has been rejected by the learned Addl. Sessions Judge, Athagarh vide order dated 07.04.2025.

Considering the submissions made by the learned counsel for the petitioner that the petitioner is

a young boy, aged about 21 years and he is in judicial custody since 21.03.2025 and in the meantime, charge sheet has already been submitted for the offences under sections 75(1)/351(2)/296 of B.N.S. and after going through the statement of the victim, placed by the learned counsel for the State and other available materials on record and on hearing learned counsel for the State, I am inclined to release the petitioner on bail.

Let the petitioner be released on bail in the aforesaid case on furnishing bail bond of Rs.50,000/(rupees fifty thousand) with two local solvent sureties each for the like amount to the satisfaction of the learned Court in seisin over the matter with further conditions as the learned Court below may deem just and proper including the conditions that the petitioner shall not try to come in contact with the victim, shall not indulge in any criminal activities and shall appear before the learned trial Court on each date to which the case would be posted for trial.

Violation of any of the conditions shall entail cancellation of bail.

The BLAPL is accordingly disposed of.
