Since these two bail applications arise out of one and same case record, the same are heard together and disposed of by this common order with the consent of the learned counsel for the parties.

These are the bail applications U/S.483 of BNSS by the petitioners for grant of bail in connection with Phulbani PR No.204/2024-25 corresponding to 2(a)CC Case No.07 of 2025 pending in the file of learned Special Judge, Phulbani for commission of offences punishable U/Ss.20(b)(ii)(C) of the NDPS Act, on the main allegation of transporting 101 Kgs of Contraband Ganja in Mahindra Bolero ZLX bearing Registration No. OD-02-AM-6377.

Satpathy, learned Addl. PP in the matter, but Mrs. Tanushree Balsamant, learned counsel appearing on behalf of Mr. Suryakanta Dasmohapatra, learned counsel for the Petitioner in BLAPL No. 4114 of 2025 prays for an adjournment, however, the bail application of the other Petitioner has already been argued and thus, this Court does not feel it proper to grant adjournment to the Petitioner in BLAPL No. 4114 of 2025 and accordingly, disposes of the aforesaid two bail applications by perusing the record.

After having considered the rival submissions and taking into consideration the nature and gravity of the offences as alleged against the petitioners vis-à-vis the allegation sought to be brought against them and regard being had to the seizure of 101Kgs of Contraband Ganja, which is well above the commercial quantity from the vehicle allegedly in occupation of the petitioners and their consequently failure to satisfy the conditions of Sec. 37 of NDPS Act, this Court is not inclined to grant bail to the Petitioners.

Hence, these two bail applications of the petitioners stand rejected.
