Instant petition under Section 483 BNSS is filed for release of the petitioner on bail in connection with G.R. Case No.2078 of 2024 pending in the file of learned S.D.J.M., Angul arising out of Angul P.S. Case No.962 of 2024 on the grounds stated therein.

Mr. Nath, learned counsel for the petitioner submits that the accused is in custody from the month of December, 2024 and he is alleged of having received the stolen items so revealed from Annexure-2, hence, therefore, considering the same and he having not played any part in the alleged robbery, should be allowed to go on bail subject to any conditions.

Mr. Sahoo, learned AGA for the State opposed such release of the accused. In course of hearing, it is informed to the Court by Mr. Nath, learned counsel for the petitioner that the accused is having no other criminal antecedents of similar nature.

Considering the F.I.R. as at Annexure-1 and the fact that the petitioner is the receiver of the articles removed from the informant, he having remained in judicial custody since the date of arrest and as claimed to be having no other antecedents of similar kind, the Court is inclined to direct him to go on bail subject to the following conditions.

In the result, petition under Section 483 BNSS stands allowed. Consequently, the petitioner is allowed to go on bail in connection with G.R. Case No.2078 of 2024 arising out of Angul P.S. Case No.962 of 2024 subject to him furnishing a bail bond of Rs.30,000/-(rupees thirty thousand) with one solvent surety for the like amount each to the satisfaction of learned S.D.J.M., Angul, who shall be at liberty to impose such other suitable conditions as deemed just and proper in the facts and circumstances of the case.
