This matter is taken up through Hybrid Arrangement (Virtual/Physical Mode).

This is an application U/S.483 of BNSS by the petitioner for grant of bail in connection with Kuakhia P.S. Case No.105 of 2023 corresponding to C.T. (Sessions) Case No.105 of 2023 pending in the file of learned Addl. District & Sessions Judge, Jajpur, for commission of offences punishable U/Ss. 302/201/34 of the IPC, on the allegation of committing murder of one Bikash Lenka.

Heard, Mr. Subash Chandra Pradhan, learned counsel for the petitioner and Mr. C. Mohanty, learned Addl. PP in the matter and perused the record.

After having considered the rival submissions upon perusal of record, there appears allegation

against the petitioner for committing murder of the deceased, but fact remains that the petitioner along with another has also been alleged to have chopped off the hands of the deceased prior to this incident in the year 2016. Right now, the trial is on full swing.

In view of the above facts and on going through the materials placed on record and taking into account the alleged conduct of the petitioner, this Court is not inclined to grant bail to the petitioner.

Hence, the prayer for bail of the petitioner stands rejected. However, the learned trial Court is requested to expedite the trial and dispose of the case as early as possible.

Accordingly, the BLAPL stands disposed of. 7. Issue urgent certified copy of the order as per Rules. A copy of this order be immediately communicated to the concerned Court for compliance.
