1. This matter is taken up through a hybrid arrangement.

2. The petitioner, who is in custody in connection with Nandipada P.S. Case No.277 of 2022, G.R Case No.444 of 2022

further corresponding to S.T Case No.23 of 2023 pending in the Court of learned Additional Sessions Judge, Anandpur for the alleged commission of offences under Section 302/201 of the IPC, has filed this petition seeking release on bail.

The brief fact of the case is that on 14.11.2022, the informant and his family members received information from Ramamani Rana of village Sadha that the mobile phone of his younger brother Anirudh Swain (deceased) was switched off. Then they came to the rented house of Anirudha Swain situated at Mareigaon and found the door of the room locked from outside and stained with blood. Thereafter the informant intimated the matter to Nandipada P.S. and after opening of door, they found the dead body of the deceased with multiple stabbing injuries and slit neck and the incriminating articles collected.

Learned counsel for the petitioner submits that the Petitioner had not assaulted the deceased and on basis of the confessional statement before the Police, which is not admissible, has been implicated in the case. He submits that the Petitioner has been languishing in custody since 02.12.2022 and in the meantime, the investigation has been completed and the charge sheet has already been filed. He further submits that there is no direct

evidence against the present petitioner. Hence, the Petitioner may be enlarged on bail.

5. Learned counsel for the State vehemently opposes the bail prayer of the petitioner. He submits that the trial has already been initiated and other material witnesses are yet to be examined and if the petitioner will be released on bail, he may flee away from the hands of justice and he may tamper with the prosecution evidence. He submits that the allegation against the Petitioner is grievous in nature, for which he should not be released on.

6. Considering the submissions made and on going through the materials as placed, further keeping in view the nature and gravity of the offence for which the Petitioner is said to have been involved, this Court is not inclined to release the Petitioner on bail.

7. Accordingly, the BLAPL is dismissed.

8. Issue urgent certified copy of the order pas per Rules.
