Instant petition is filed for release of the petitioner on bail in connection with G.R. Case No.2030 of 2024 corresponding to Pahala P.S. Case No.454 of 2024 pending in the file of learned J.M.F.C (O), Bhubaneswar on the grounds stated therein.

Mr. Panda, learned counsel for the petitioner submits that the transaction has taken place in between 2010 and 2014 for having the petitioner received an amount of Rs.22 lac in total but there is no evidence in support thereof and that apart, the petitioner has been in judicial custody since the date of arrest and considering the same and that substantial part of investigation is concluded, the petitioner should be allowed to go on bail with any conditions as would be imposed by the Court but the same is objected to by Mr. Pradhan, learned ASC for the State with the submission that the informant has been cheated as he was neither provided a plot or refunded the money.

Gone through the FIR as at Annexure-1 and rejection order i.e. Annexure-2. From the report, it is made to understand that an amount of Rs.22 lac was received almost 10 years back by the petitioner allegedly from the informant and the said amount was received by the accused with a promise to provide him a plot. It is alleged in the FIR that money was not refunded nor any plot was provided by the petitioner. The investigation, as it appears, has progressed to a considerable extent, so revealed from the rejection order i.e. Annexure-2. Having regard to the above facts and considering the submissions of learned counsel for both the sides, the Court is of the view that the petitioner, in order to ensure payment or refund of money received from the informant, should be allowed to go bail with following conditions.

5. Accordingly, it is ordered.

In the result, the petition stands disposed of with a direction to release the petitioner on bail in connection with G.R. Case No.2030 of 2024 corresponding to Pahala P.S. Case No.454 of 2024 subject to him furnishing a bail bond of Rs.50,000/- (rupees fifty thousand) with two solvent sureties for the like amount each to the satisfaction of the learned J.M.F.C (O), Bhubaneswar, and to deposit an amount of Rs.2 lac payable to the informant besides to furnish property security of Rs.20 lac. Only upon fulfillment of the above conditions, release of the petitioner shall be given effect to.
