Heard Mr. Nanda, learned counsel for the petitioner and Mr. Sahoo, learned AGA for the State.

Instant petition under Section 483 BNSS is filed for release of the petitioner on bail in connection with G.R. Case No.2062 of 2024 pending in the file of learned S.D.J.M., Talcher corresponding to Talcher P.S. Case No.1067 of 2024 for commission of offences under Section 52(a)(i) of the Odisha Excise Act on the grounds stated therein.

Gone through the F.I.R. as at Annexure-1.

Considered the submissions of learned counsel for both the sides.

As made to reveal from Annexure-1, good quantity of I.M.F.L. has been seized from the shop of the petitioner. It is alleged that the petitioner possessed the IMF bottles without any licence. Considering the fact that such recovery and seizure is over with substantial part of investigation being concluded, the Court, regard being had to the fact that the petitioner is a local resident and the licence holder to run a liquor shop, should be allowed to go on bail subject to following conditions.

Hence, it is ordered.

In the result, petition under Section 483 BNSS stands allowed. Consequently, the petitioner is directed to go on bail in connection with G.R. Case No.2062 of 2024 corresponding to Talcher P.S. Case No.1067 of 2024 subject to him furnishing a bail bond of Rs.40,000/-(rupees forty thousand) with one solvent surety for the like amount to the satisfaction of the learned S.D.J.M., Talcher, who shall be at liberty to impose such other suitable conditions as deemed just and proper in the facts and circumstances of the case.
