Learned counsel for the petitioner submits that the name of the petitioner in the cause title has been wrongly typed as Babu @ Dillip Kumar Das @ Dilip Das instead of Baba @ Dillip Kumar Das @ Dilip Das, hence, the same be corrected and read as Baba @ Dillip Kumar Das @ Dilip Da s .

Instant petition is filed for release of the petitioner on bail in connection with G.R. Case No.672 of 2023 arising out of Chauliaganj P.S. case No.165 of 2023 pending in the file of learned JMFC, Cuttack on the grounds stated therein.

Perused the rejection order and the FIR as at Annexures-1 and 2 respectively.

In course of hearing, it is submitted that petitioner similarly situated like the co-accused, namely, Kamala Kanta Barik, who has been released on bail vide BLAPL No.3670 of 2024, a copy of which is at Flag-A. The allegation is with regard to extortion and demand of ransom of Rs.5 lac by the accused persons. From Annexure-1, the Court finds that seizures have been made in connection with the case. It is informed to the Court by Mr.

Vidyabhusan, learned counsel for the petitioner that the trial has already commenced upon closure of investigation. Recording such submission and objection of Mr. Ray, learned AGA for the State and in view of the order in BLAPL No.3670 of 2024 and considering the plea that the petitioner is on equal footing like the co-accused above named, the Court is inclined to grant him bail with following conditions.

6. Accordingly, it is ordered.

In the result, the petition stands allowed. As a necessary corollary, the petitioner is directed to be released on bail in connection with G.R. Case No.672 of 2023 arising out of Chauliaganj P.S. case No.165 of 2023 subject to him furnishing a bail bond of Rs.40,000/- (rupees forty thousand) with two solvent sureties for the like amount each to the satisfaction of the learned JMFC, Cuttack, who shall impose such other conditions as deemed just and proper in the facts and circumstances of the case besides the following, such as, he shall not indulge in similar offences and shall appear before the trial court on each and every date fixed and shall not leave the jurisdiction of the Trial Court without prior permission of the trial court besides the above to furnish to cash security of Rs.10,000/- before the court seisin over the matter, which shall be kept in any nationalized bank in interest bearing account initially for a period of one year renewable from time to time till conclusion of trial and the same shall be abide by the final outcome of the trial of the case.

8. The BLAPL is disposed of.
